TERMS AND CONDITIONS Last updated: 25 June 2026 Effective for: ashweb.site ("ASHWEB", "we", "us", "our") 1. Acceptance of Terms These Terms and Conditions ("Terms") govern your access to and use of ashweb.site (the "Site") and all related services offered by ASHWEB ("we", "us", "our"), including wedding invitation templates, custom invitation design, and website/RSVP page building (collectively, the "Services"). By accessing the Site, placing an order, or otherwise using the Services, you ("Customer", "you") agree to be bound by these Terms. If you do not agree, please do not use the Services. You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order with us. 2. Our Services We offer the following, individually or in combination: - Templates: pre-designed digital wedding invitation templates available for purchase and personalization. - Custom Design: bespoke wedding invitation design created to your specifications, brief, and revisions as agreed. - Website / RSVP Builder: a hosted invitation webpage, optionally including an RSVP form that collects guest responses and stores them for your access. We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with reasonable notice where practicable. 3. Orders, Quotes, and Process - Orders are currently placed by contacting us directly (e.g. via WhatsApp, email, or contact form). We will confirm scope, pricing, timeline, and revisions included before starting work. - For custom design work, the order is confirmed only once payment (or an agreed deposit) is received and acknowledged by us. - Delivery timelines communicated to you are estimates. While we will make reasonable efforts to meet them, delays may occur due to revision requests, incomplete information from you, or circumstances beyond our control. - You are responsible for providing accurate event details, names, dates, spellings, and content for your invitation. We are not liable for errors in the final product that result from incorrect or incomplete information you provided, though we will assist with corrections per our revision policy. 4. Pricing and Payment - Current payment method: payment is currently accepted via UPI, coordinated directly with us after you contact us for a quote. We will share UPI payment details upon order confirmation. - We do not store your UPI PIN or banking credentials. You are responsible for verifying payment details before transferring funds, and for retaining your own transaction confirmation/reference. - Future payment methods: we intend to add Razorpay or similar payment gateway services. Once added, payments made through such gateways will additionally be subject to that payment provider's own terms and privacy policy, and these Terms will be updated to reflect that integration. - All prices are quoted in the currency communicated at the time of order and are exclusive of any applicable taxes unless stated otherwise. We reserve the right to change our pricing for future orders at any time; price changes do not affect orders already confirmed. - Work will not commence (for custom design) or files will not be delivered (for templates) until payment, or the agreed deposit, is received and confirmed. 5. Cancellations and Refunds Because much of our work involves time and creative effort committed upfront, refunds are handled as follows: - Before work begins: if you cancel before we have started any design work on your order, you are entitled to a full refund of any amount paid. - After work has started: once custom design work has begun, any deposit or payment made is non-refundable, as it compensates time and resources already committed. We may, at our discretion, offer a partial refund or credit depending on how much work has been completed. - After final delivery: once final design files have been delivered and/or your website/RSVP page has been published, the order is considered complete and is not eligible for a refund, except where the delivered work materially fails to match the agreed brief (see Section 6). - Template purchases: being digital products delivered instantly, template purchases are non-refundable once the files have been delivered/downloaded, except where the file is defective or materially different from what was advertised. - Refunds, where due, will be processed to the original payment method (or another method we mutually agree) within a reasonable time after approval. 6. Revisions and Quality - The number of revision rounds included in custom design work will be communicated and agreed at the time of order. Revisions beyond the agreed number may incur an additional fee. - If you believe the delivered work does not reasonably match the agreed brief, you must notify us within 7 days of delivery so we can review and address the concern, which may include a further revision or, where appropriate, a partial refund. 7. Intellectual Property and Usage Rights Custom designs: ASHWEB retains ownership of the underlying design work, artwork, and creative elements we create for you. Upon full payment, you are granted a personal, non-exclusive, non-transferable licence to use the final delivered files for your own wedding/event purposes (e.g. sending to guests, printing, publishing on your invitation page). This licence does not permit you to resell, sublicense, redistribute as a template, or claim authorship of the design. Templates: purchase of a template grants you a licence to personalize and use that template for your own single event, as described at the time of purchase. Templates remain our intellectual property and may not be resold, redistributed, or repurposed as a product by you. Our content: all site content, branding, template designs, and underlying code are the property of ASHWEB or its licensors and may not be copied, scraped, or reused without permission. Content you provide: you retain ownership of photos, names, and text you provide to us. By submitting them, you grant us a licence to use them solely to create and deliver your invitation/website, and you confirm you have the right to share them with us (e.g. rights to any photos used). 8. RSVP / Website Builder Feature - If you enable an RSVP section on your invitation page, you are responsible for informing your guests about what information is being collected and for what purpose, in line with applicable privacy law. - We store guest responses on your behalf as described in our Privacy Policy and make them accessible to you. We are not responsible for the accuracy of information guests submit. - Hosted invitation pages will generally remain live for a reasonable period following your event (as communicated at the time of order), after which they may be archived or taken down. You may request earlier takedown or extended hosting (subject to fees, if applicable) by contacting us. - You must not use the RSVP/website builder feature to collect sensitive personal data beyond what is reasonably necessary for event planning, or for any unlawful purpose. 9. Acceptable Use You agree not to: - Use the Services for any unlawful, fraudulent, defamatory, or harassing purpose. - Upload content that infringes third-party intellectual property, privacy, or other rights. - Attempt to gain unauthorized access to our systems, other users' data, or disrupt the Site's operation. - Use our templates or designs to build a competing product or service. We reserve the right to refuse service, suspend access, or take down any hosted page that violates these Terms. 10. Disclaimers The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site or hosted pages will be uninterrupted, error-free, or available at all times. We are not responsible for: (a) printing quality if you print delivered files yourself or through a third party; (b) delays caused by incomplete or late information from you; (c) issues arising from your own internet connection, device, or browser; or (d) third-party services (such as payment gateways or hosting providers) outside our direct control. 11. Limitation of Liability To the maximum extent permitted by applicable law, ASHWEB's total liability arising out of or relating to these Terms or the Services shall not exceed the total amount you paid to us for the specific order giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of guests' attendance, event disruption, or emotional distress, even if we have been advised of the possibility of such damages. Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded under applicable consumer protection law in your jurisdiction. 12. Indemnity You agree to indemnify and hold harmless ASHWEB, its owner, and any associates from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) content you provide to us infringing a third party's rights; or (c) your misuse of the Services. 13. Third-Party Services Our Services may rely on or link to third-party services, including hosting providers, database providers, and (in future) payment gateways such as Razorpay. We are not responsible for the practices, content, or availability of third-party services, which are governed by their own terms and privacy policies. 14. Privacy Our collection and use of personal data, including Customer data and Guest RSVP data, is governed by our Privacy Policy, which forms part of these Terms by reference. 15. Termination We may suspend or terminate your access to the Services at any time if you breach these Terms, engage in fraudulent or abusive behaviour, or for any other reasonable cause, with notice where practicable. You may stop using the Services at any time; this does not entitle you to a refund except as described in Section 5. 16. Changes to These Terms We may update these Terms from time to time, including to reflect new features (such as Razorpay integration) or legal requirements. The updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms. Changes will not retroactively apply to orders already confirmed before the change, unless required by law. 17. Governing Law and Dispute Resolution These Terms are governed by the laws of India. Subject to applicable consumer protection rights you may have in your own country, any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved amicably through good-faith discussion, and failing that, shall be subject to the exclusive jurisdiction of the courts of 72WQ+7F3, Kariwali Rd, Bhiwandi, Karivali, Maharashtra 421302, India. 18. Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be replaced with a valid provision that most closely reflects its original intent. 19.
